Since 1979, all motorists living in Montana, with or without a Driver’s Licenses, are required to have liability insurance on their moving vehicle. The first conviction of not being covered by bond or insurance results in a fine of $250 to $500, or imprisonment in the county jail for not more than 10 days, or both; with higher amounts usual in traffic accident cases.

The penalties for a second conviction increase to $350 to $500, or imprisonment in the county jail for not more than 10 days or both. A third or subsequent conviction results in a guaranteed $500 fine or imprisonment in the county jail for not more than 6 months, or both.

A fourth or subsequent conviction results in the suspension of the person’s driver’s license. The suspension is in effect until the person can provide proof of compliance only by purchasing an SR-22 insurance policy. The insurance company is required to file a certificate with the Montana Department Of Justice stating that a motor vehicle liability insurance policy is in effect.

Repeat traffic violations, one at-fault accident, or one DUI (driving under the influence of drugs or alcohol) conviction will guarantee the driver a suspended license and the need to obtain an SR22. In addition, once a driver is convicted of not carrying liability insurance for the second time, the person must surrender his or her vehicle’s license plates to the Department Of Justice. The vehicle may not be re-registered until proof of financial responsibility is provided to the Department.

In almost every case, this policy must be maintained for a 3-year period. The insurance company is required to notify the Department if the policy is terminated or lapses. The Department always immediately suspends the person’s driver’s license as soon as it receives official notification from the insurance carrier.

Obtaining SR22 insurance can be expensive because it is usually only issued to poor drivers with multiple convictions. Several insurance companies refuse to insure these types of drivers, so it can sometimes be difficult to find at a low cost.
